Court Upholds Arkansas Trans Youth Care Ban

Arkansas has officially doubled down on denying trans kids medical care — and the courts just handed conservatives their victory ribbon. A federal appeals court upheld the state’s sweeping ban on gender-affirming care for minors, blocking doctors from prescribing puberty blockers, hormones, or performing surgery for transgender youth.

In an 8-2 ruling, the 8th U.S. Circuit Court of Appeals sided with Arkansas’ Republican attorney general, who argued the law doesn’t discriminate against transgender minors. The decision leaned heavily on a June Supreme Court ruling that upheld Tennessee’s nearly identical ban. But the appeals court didn’t stop there — it went further, claiming parents don’t have the constitutional right to secure medical treatment for their children if the state decides it’s “inappropriate.”

“This court finds no such right in this Nation’s history and tradition,” wrote Judge Duane Benton, in an opinion signed by seven other Republican-appointed judges. Translation: if your kid is trans, tough luck — the state gets the final say.


Dissent and Despair

Not everyone on the bench was buying it. Judge Jane Kelly, joined by another Democratic-appointed judge, tore into the majority’s reasoning. She blasted the ruling for having a “startling lack of evidence” connecting Arkansas’ ban to its supposed goal of “protecting children.” LGBTQ advocates were even more blunt. Holly Dickson of the ACLU of Arkansas called the ruling “a tragically unjust result for transgender Arkansans, their doctors and their families.”

This decision wipes out a 2023 lower court ruling that had struck down the law as unconstitutional, after blocking it from taking effect in 2021. Back then, Arkansas became the first state to pass such a law, bulldozing it through the legislature over the veto of then-Governor Asa Hutchinson. Today, bans like Arkansas’ are the law of the land in 25 states.
