In a significant legal victory for LGBTQ+ rights, the state of Georgia has reached a settlement in a lawsuit aimed at securing gender-affirming healthcare coverage for state employees, public school teachers, and former employees covered by the state health insurance plan. The lawsuit, filed in December, alleged that the state’s insurance plan was engaging in illegal discrimination by refusing to cover gender-affirming care. The plaintiffs argued that there was no moral, medical, or legal justification for treating transgender healthcare differently from other forms of medical treatment. David Brown, a lawyer representing the plaintiffs, emphasized the importance of equal access to healthcare for all individuals.
As part of the settlement, the state will not only provide gender-affirming healthcare coverage but also pay a total of $365,000 to the plaintiffs and their legal representatives. This compensation aims to address the financial burden incurred by the plaintiffs, who had to pay for medically necessary procedures out of their own pockets due to insurance coverage denials.
While Georgia had recently implemented restrictions on hormone therapy and gender-affirming surgeries for individuals under 18, this settlement obligates the state health plan to cover medically necessary care for spouses, dependents, and employees. It is noteworthy that the plan may be required to provide care for minors even if such procedures are prohibited within the state.
The lawsuit invoked a 2020 Supreme Court ruling that affirmed the illegality of treating individuals differently based on their gender identity or sexual orientation, citing a section of the Civil Rights Act of 1964.
