Just days after the U.S. Court of Appeals for the Fourth Circuit agreed to rehear the case of Wilkins v. Hegseth, they clarified that qualified individuals living with HIV can once again join the armed forces while the case moves forward. The court’s order, issued on Tuesday, lifted a stay that had allowed the Pentagon to enforce its ban on HIV-positive enlistments. Now, those whose condition is well-managed and whose viral load is suppressed to undetectable levels—thanks to modern medicine—can proudly serve their country. This principle, known as U=U (undetectable equals untransmittable), is a game changer!

Attorney Peter Perkowski, representing the plaintiffs, expressed his excitement, stating, “This was unexpected but great news. On a regular basis, I hear from people with HIV who want to serve their country by joining the military, and that’s now again a viable option.” Can we get a round of applause for that?

The legal battle began in 2022 when three individuals were denied military opportunities due to their HIV status. This case has become a significant challenge against the military’s HIV-specific restrictions, which have been struck down in various instances, showcasing how the law is finally catching up with medical advancements.

In previous rulings, courts have recognized that the Pentagon’s policies failed to align with modern medicine, leading to the abandonment of deployment restrictions for service members living with HIV. Yet, the enlistment ban stubbornly remained in place, until now.

In August 2024, U.S. District Judge Leonie Brinkema ruled that the ban was “irrational, arbitrary, and capricious,” and that it contributed to the stigma surrounding HIV while undermining the military’s recruitment goals. The government’s appeal saw the Fourth Circuit siding with the Defense Department in February, but the tides have turned!

With the stay now lifted, the district court’s injunction remains in effect until the full Fourth Circuit hears arguments in September. The court’s decision to reinstate the injunction is a glimmer of hope for advocates fighting against discrimination based on HIV status.

Perkowski added, “We are grateful the full Court reinstated the injunction remedying the Defendants’ ongoing unlawful discrimination against people living with HIV. And just a little bit hopeful it’s a sign of good things yet to come in the Fourth Circuit.” Let’s keep our fingers crossed!
