In their letter to education secretary Bridget Phillipson, Ed Davey and women’s and equalities spokesperson Marie Goldman expressed their concerns, stating, “We do not believe that the new code of practice is fit for purpose. It does not provide clear and workable guidance, and it does not do enough to protect everyone from discrimination, harassment and victimisation.” They added, “We do not want to become a country where people are barred from accessing essential services simply for who they are, or where women are asked to prove that they are women, just to go about their lives.” Sounds reasonable, right?

But the EHRC’s new guidance, which was published in May, has stirred up quite the controversy. The code of practice, which spans over 300 pages, lays out how services should operate based on biological sex to qualify as single-sex under the Equality Act. It even suggests that, in certain limited circumstances, it might be okay to ask someone to confirm their sex. However, it emphasizes that this must be done “as sensitively as possible” and must respect privacy. So, where does that leave us?
