The Equality and Human Rights Commission (EHRC), the United Kingdom’s human rights watchdog, is currently under review due to allegations of taking an “actively harming” approach towards trans rights. This controversy stems from Chairwoman Baroness Falkner’s support for amending the 2010 Equality Act to define sex as “biological sex.” LGBTQ+ charities have accused the EHRC of a lack of political independence from the Tory government, suggesting that it is actively harming transgender individuals in the UK.
The Global Alliance of National Human Rights Institutions (GANHRI) has initiated a special review of the EHRC in response to a complaint filed by Stonewall and 30 other LGBTQ+ charities. These organizations argue that the EHRC has become a “failed institution” and its work undermines the status of independent human rights institutions and systems.
In a Telegraph article, Baroness Falkner expressed her disappointment with the investigation, suggesting that the EHRC was targeted because of its advice on the Equality Act. She denied allegations of colluding with the UK government to erode the rights of trans people, emphasizing the EHRC’s commitment to protect and promote equality and everyone’s rights.
The investigation could have significant consequences for the EHRC, potentially affecting its accreditation as an A-status human rights organization. If the EHRC were to lose this status, it could result in the institution losing its seat at the UN Human Rights Council and other United Nations bodies.
Robbie de Santos, the director of external affairs at Stonewall, welcomed the news of the investigation, pointing out that the EHRC had fallen short of recommendations made during its periodic review in October 2022. He expressed hope that the special review would provide the EHRC with the scrutiny and recommendations necessary to fulfill its role in supporting LGBTQ+ communities.
